Terms of Use

Acceptance
These Terms govern your use of the PRISM Tax Intelligence website and the tools published on it. By using the site you accept them. If you are engaged with PRISM under a separate written engagement letter or service agreement, that agreement governs the professional work and controls wherever it differs from these Terms.
What PRISM offers on this site
General website information. Pages describing the practice, its services, pricing, and how the work is performed.
Educational content. The PRISM Library and related explanatory material about tax rules, elections, and common situations, written for a general audience.
Decision-support tools. Refund estimates, projections, scenario comparisons, and calculators that model outcomes from the figures and assumptions you enter.
Subscription plans. Paid access to the projection and decision-support features, billed through our payment processor.
Client workspace. A secure, authenticated area where engaged clients exchange documents and information with PRISM.
Professional services. Individual tax preparation, tax planning, notice and correspondence work, and complex decision support performed by PRISM under a specific engagement.
No professional engagement is created by using the site
A tax professional relationship with PRISM begins only when PRISM and you have agreed on the scope of work and PRISM has confirmed the engagement in writing. Nothing else starts one — not visiting the site, reading an article, running a projection or calculator, downloading material, submitting a general inquiry, booking or attending an introductory call, or creating an account.
The introductory call is an opportunity to understand your situation and determine the appropriate next step. Until an engagement is confirmed, PRISM is not performing work on your behalf, is not tracking filing deadlines for you, and is not responsible for any tax position you take.
Educational and decision-support information
Published articles, explanations, and tool output are written for general circumstances. They are not prepared with knowledge of your complete facts and are not individualized tax advice about your return or your situation. Do not treat them as a substitute for a professional review of your own circumstances.
This limitation applies to the free, self-serve parts of the site. Work PRISM performs for you under an engagement is professional work, and PRISM stands behind it under the terms of that engagement.
Projections and estimates
Projections, scenarios, comparisons, and estimated amounts depend entirely on the information supplied, the assumptions applied, the tax law in effect for the modeled year, and events that have not happened yet. Incomplete, inaccurate, or changing facts change the result.
Output is a model, not a guarantee of a refund, liability, penalty exposure, or any other eventual tax outcome, and it is not a representation of how a taxing authority will treat a position.
Tax law changes
Federal and state statutes, regulations, administrative guidance, published rulings, and their interpretation change, sometimes retroactively. Material on this site describes the law as PRISM understood it when the material was prepared or last reviewed. PRISM does not undertake to update published content, saved scenarios, or prior tool output when the law changes.
Your responsibilities
Provide accurate and complete information when you use PRISM's forms, tools, workspace, or services, and keep your account credentials confidential. You are responsible for activity under your account.
Do not misuse the site or its systems: no unauthorized access attempts, no probing or interfering with security controls, no automated scraping or bulk extraction, no uploading of malicious files, no submitting another person's information without authority, no reverse engineering of the tools, and no use of the site to violate law.
Intellectual property
The original content PRISM publishes — website copy, articles and other educational material, downloadable materials, software and source code, decision-support interfaces, graphics and brand marks, and PRISM's analytical methodologies to the extent legally protectable — belongs to PRISM Tax Intelligence and is protected by intellectual property law.
You may read, print, and share PRISM's published material for your own personal or internal business use with attribution intact. Republication, resale, systematic copying, or use of PRISM material to build a competing product is not permitted without written consent.
PRISM claims no ownership of government forms, statutes, regulations, IRS or state tax authority publications, or other public-domain government material referenced or reproduced on the site. Output generated from figures you enter is yours to use.
Third-party services and links
Parts of the site rely on third parties: appointment booking is handed off to a Google Calendar scheduling page, payments are processed by Stripe, hosting and authentication run on our backend provider, and site measurement uses Google services subject to your consent choice. Their own terms and policies apply to your interaction with them. The Privacy Policy describes what information those services receive.
Links to outside websites and authorities are provided for reference. PRISM does not control and is not responsible for their content.
Purchases, subscriptions, and delivery
PRISM Pro is an annual subscription. The price is $390 for a one-year term, billed through Stripe when you complete checkout. Prices are in U.S. dollars and exclude any taxes that may apply. There is no monthly PRISM Pro plan. You authorize the charge when you complete checkout and you are responsible for keeping a valid payment method on file.
Initial annual purchase. Your $390 purchase provides PRISM Pro access for the full annual term. Access is delivered immediately in your account and continues through the end of that term.
Cancellation. You can cancel future renewal at any time from the billing portal linked in your account. Cancelling stops the next renewal. It does not end the annual term you have already paid for, and it does not convert the subscription into a month-to-month plan. Your Pro access continues through the end of the current paid term. Stopping use of PRISM Pro before the term ends does not by itself create a prorated refund.
Renewal. Unless cancelled before the renewal date, PRISM Pro renews for another one-year term at the then-current price disclosed to you. We will send the renewal price, renewal date, and cancellation instructions to the email address on your account before the renewal takes effect.
Unintended renewal. If an annual renewal charge was unintended, contact PRISM within 7 days of that charge at info@prismtaxintelligence.com. Where there has been no substantial use of PRISM Pro after the renewal — meaning no Scenario Analysis run, no Decision Record created or edited, and no export generated since the renewal date — we will ordinarily refund that renewal charge. This applies to a renewal charge only, not to your initial annual purchase.
Exceptional circumstances. Nothing here limits our ability to resolve duplicate charges, billing errors, material technical failures, or other exceptional situations individually. Contact us and we will work it out with you directly.
Professional services are quoted and invoiced separately under the terms of the applicable engagement, not through these Terms.
Refunds and cancellations for professional services
This section applies to PRISM’s individually engaged professional services — tax preparation, tax planning, projection work, notice-response work, and other advisory engagements.
If you have signed an engagement letter or other written client agreement with PRISM, that agreement governs fees, deposits, cancellation, and any refund. Nothing on this page changes or replaces it, and where the two differ, the engagement agreement controls.
Where no written agreement addresses the question, refund and cancellation requests are handled individually. Contact PRISM to discuss the engagement — what was requested, what work has been performed, and what outcome makes sense — and we will resolve it with you directly. These Terms do not set an automatic refund, an automatic no-refund rule, a proration formula, or a cancellation deadline for professional services. Those provisions exist only where an engagement agreement states them.
Availability
The site and tools are provided on an “as available” basis. Features may change, be suspended for maintenance, or be discontinued. PRISM aims to give notice of material changes affecting paid features.
Disclaimers and limitation of liability
The free, self-serve portions of the site — published content, calculators, projections, and other tools — are provided without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
To the fullest extent permitted by law, PRISM is not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or lost data, arising from your use of the website or its free tools. PRISM's total liability arising from your use of the website and its free tools is limited to the amount you paid PRISM for access to those tools in the twelve months before the claim.
These limitations do not apply to professional services PRISM has contracted to perform for you. Responsibility for that work is governed by your engagement agreement and by the professional standards that apply to it, and nothing here limits liability that cannot be limited under applicable law.
Privacy
How PRISM handles information, what is and is not sent to analytics platforms, cookies and storage, consent, and California privacy rights are described in the Privacy Policy, which is part of these Terms.
Suspension and termination
PRISM may suspend or close access to an account or the workspace for misuse of the site, non-payment, or where required by law or professional obligation. You may stop using the site at any time. Provisions on intellectual property, disclaimers, limitation of liability, and governing law survive.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising from the website or these Terms is subject to the exclusive jurisdiction of the state and federal courts located in New York, and each party consents to venue there.
Changes to these Terms
When these Terms change, the revised version is posted here and the “last updated” date above is revised. Continued use of the site after a change means you accept the revised Terms.
