Does New York Tax Government Pensions?

    Quick answer

It depends on which government paid the pension. Qualifying New York State and local government pensions and qualifying federal government pensions can receive different New York treatment from other pension income. An out-of-state government pension should not automatically be treated as though it were a New York State, local, or federal government pension.

    What can change the answer?

    • The exact pension payer.
    • The pension plan.
    • Federal vs New York State/local vs other government source.
    • Whether the pension is included federally.
    • Taxpayer age.
    • Whether another New York pension exclusion applies.

    The rule being applied

New York provides a full subtraction for qualifying New York State/local government and federal government pension distributions included in federal adjusted gross income. A pension from another state or local government does not automatically qualify for that same subtraction and may need to be evaluated under other New York pension rules.
